In the US, it’s illegal for anyone to “transfer” money out of a bank by way of an ATM or other payment machine. In most other countries, you have to get a court order to transfer money or use a credit card. However, in the US, it’s legal to “transfer” money out of your bank account and into your credit card account.
While it is certainly the case that a person can’t buy a product or use a service with a stolen credit card or bank account, it is also the case that a person can’t transfer money out of their bank account into a credit card account that is owned by someone else. However, by using a credit card in such a transaction, the person using the card is just committing the crime of stealing.

For instance, if a card holder gave a merchant a check drawn on a bank account owned by another card holder, that person would be committing the crime of swindling the merchant.

I’m going to have to agree with the poster about using a credit card to buy something. If you are a true merchant and you dont have a checking account, then you are not in violation of the law. However, if you are a true merchant and you dont have a checking account, and you have a credit card, then you are in violation of the law. This is because you are not making a payment for someone else to buy something with the credit card.
The law may not actually be as strict as you think, as the card companies make it seem. In fact, there are a number of states where you can simply use a credit card to purchase something without having to go through a credit check. You will be in violation of the law if you use a credit card with a charge card to purchase something.
The first state to offer this is Arizona, where you must go to a credit card processing place for approval. In fact, you may also be charged with a crime if you receive a debit card from someone who you know is a criminal.
There are a lot of states that have laws against using a credit card for illegal activities, so you have to be careful. The good news is that, at least in most states, you won’t be in violation if you simply use a credit card for something legal.
